In a historic legal escalation, Fire and Fury author Michael Wolff has filed a bombshell lawsuit against First Lady Melania Trump, claiming she and President Donald Trump are weaponizing the legal system to suppress journalism related to Jeffrey Epstein.
The suit, filed Tuesday night in New York state court, accuses Melania Trump of threatening a $1 billion defamation lawsuit in retaliation for statements Wolff made on his podcast Inside Trump’s Head, co-hosted with media executive Joanna Coles.
“This is the first time in U.S. history that a First Lady is being sued while in office,” said constitutional attorney Rachel Steinberg. “And it’s over something that touches one of the darkest scandals in modern American politics—Epstein.”
The First Lady’s threat was prompted by Wolff’s commentary suggesting that the origins of Melania’s relationship with Donald Trump may have intersected with Epstein’s social circle—specifically aboard the late sex trafficker’s infamous private jet
In a cease-and-desist letter from her attorney Alejandro Brito, Melania Trump claimed Wolff made “false, defamatory, and lewd statements,” labeling them “extremely salacious.” The letter demanded immediate retraction—or face a staggering $1 billion lawsuit.
Wolff’s response? A lawsuit of his own, invoking New York’s Anti-SLAPP statute—a law designed to protect journalists and citizens from retaliatory lawsuits filed by the powerful.
“I didn’t want to file this,” Wolff said in a statement released early Wednesday. “But I’ve been a journalist for four decades. I’ve written four books about Donald Trump and never been sued—until now.”
He continued, “This is an obvious SLAPP suit—an intimidation tactic to scare me out of reporting on Epstein’s ties to Trump. If Melania and Donald want to go to court, then let’s do it under oath.”
Wolff’s lawsuit doesn’t just seek to block Melania’s legal threats—it also asks the court to compel both Melania and Donald Trump to testify under oath about their dealings with Epstein and his longtime associate, Ghislaine Maxwell.
“I look forward to asking the First Couple about their relationship with Jeffrey Epstein—on the record, under oath, and in full public view,” Wolff added.
Donald Trump’s association with Epstein has been widely documented. The two were photographed together multiple times in the late 1990s and early 2000s, including at Trump’s Mar-a-Lago estate. By 2004, Trump publicly distanced himself from Epstein, reportedly after a falling out over a real estate deal and growing rumors of Epstein’s abuse of underage girls.
Melania Trump, however, has long denied any significant contact with Epstein and has published her own memoir asserting she met Trump at the now-defunct Kit Kat Klub during 1998 Fashion Week. But Wolff and other investigative journalists continue to probe whether that account tells the full story.
After Melania’s legal team sent its billion-dollar threat, The Daily Beast—where Wolff’s podcast is hosted—quietly retracted a headline and pulled a podcast segment referencing Melania’s alleged Epstein ties.
“We apologize to the First Lady and our readers,” The Daily Beast wrote in a public statement, citing that the article did not meet “editorial standards.”
Critics see the move as capitulation under duress.
“This is how authoritarianism creeps in,” said First Amendment advocate Maya Chen of Columbia Journalism Review. “Powerful people use billion-dollar lawsuits as a threat to silence uncomfortable truths. Wolff’s lawsuit is a direct challenge to that tactic.”
In his court filing, Wolff paints the Trumps as serial abusers of the legal system, alleging they have built a culture of fear meant to discourage reporters from investigating uncomfortable truths.
“The Trumps and their MAGA myrmidons seek North Korean-style confessions, apologies, and retractions,” the suit reads. “This is not just about me. It’s about preserving the right to inquire, to question, and to expose.”
The lawsuit states that Melania’s legal threat was designed to “impede and chill future reporting and writing that Mr. Wolff has committed to doing regarding Epstein, Mr. Trump and Mrs. Trump.”
So far, the Trump White House has not formally responded to the suit, but President Trump has previously lashed out at Wolff, calling him a “Third Rate Reporter, who is laughed at even by the scoundrels of the Fake News.”
A White House spokesperson referred reporters to Melania’s memoir, Melania, calling it “the definitive account of her relationship with President Trump.”
Legal experts say the case could drag on for months—right as President Trump is ramping up his 2026 re-election campaign and facing continued investigations related to the January 6 insurrection and foreign business entanglements.
But one thing is clear: if Wolff’s request is granted, the First Lady and President may have to answer, under oath, what they really knew about Epstein—and when.
“This is about more than gossip,” said Steinberg. “This is about truth. And for once, we might actually get some of it—on the record.”
