“This smells like a cover-up,” says House Oversight Chair as physician refuses to answer questions on Biden’s cognitive health.
In a stunning move that’s sent shockwaves through Washington, Dr. Kevin O’Connor — President Joe Biden’s longtime physician — invoked the Fifth Amendment during a closed-door session with the House Oversight Committee on Tuesday. The physician, who served Biden for over a decade and held the title of White House doctor during his presidency, refused to answer questions regarding the former president’s mental fitness while in office.
Dr. O’Connor’s silence has only fueled Republican claims that key officials in the Biden White House may have conspired to hide the president’s alleged cognitive decline.
“This is a red flag,” declared Committee Chair Rep. James Comer (R-KY). “Dr. O’Connor didn’t just plead the Fifth — he ran from transparency. The American people deserve to know if their president was fit for duty, or if this was a massive deception at the highest level.”
According to a statement from O’Connor’s attorney David Schertler, the doctor’s refusal to testify was based on “two overlapping grounds” — doctor-patient confidentiality and “a pending Department of Justice criminal investigation.” The DOJ probe has not been made public, but the implication has sparked fresh speculation about a deeper federal inquiry into the Biden administration’s inner workings.
“Dr. O’Connor is invoking his constitutional rights not because he is guilty of anything,” Schertler wrote, “but to protect himself from being caught in a politically charged and legally ambiguous situation.” He also emphasized that invoking the Fifth should not be viewed as an admission of guilt.
But House Republicans aren’t buying it.
“This doctor was more than a physician — he was a gatekeeper to the truth about Biden’s health,” Comer posted on X. “He refused to say whether he was told to lie about Biden’s condition. That says everything.”
Dr. O’Connor’s ties to the Biden family extend beyond his medical role. He has also been linked to Biden family business dealings, raising further questions from GOP investigators about conflicts of interest. Committee Republicans suspect that O’Connor may have played a dual role — both as personal physician and as part of an inner circle working to preserve the image of a fully functioning president.
The investigation doesn’t stop here. Comer’s team is also pursuing testimony from former Biden aides including Karine Jean-Pierre, Ian Sams, and Jeff Zients, all of whom are expected to appear in the coming weeks. Former Biden adviser Neera Tanden already testified behind closed doors last month, telling reporters afterward that she “answered every question.”
Democrats, however, are slamming the inquiry as a political circus.
“Republicans don’t care about truth or health — they care about headlines,” said Rep. Robert Garcia (D-CA), the top Democrat on the committee. “This investigation is a distraction from the real issues facing the American people.”
Still, the optics of a presidential doctor pleading the Fifth amid a DOJ investigation and claims of mental incompetence are politically explosive — and may further erode public confidence in the Biden presidency, even after its conclusion.
As Comer promised more subpoenas, he left reporters with one final statement: “This isn’t over. Not by a long shot.”
