In a stunning rebuke of President Donald Trump’s immigration crackdown, the Supreme Court has temporarily blocked his use of the centuries-old Alien Enemies Act to fast-track deportations of Venezuelan migrants—delivering a rare blow from a bench he once counted as friendly turf.
The unsigned opinion came down Friday and paused the Trump administration’s effort to wield the 1798 law—a relic from the John Adams era—to expel asylum seekers without the typical legal safeguards. The ruling came in response to a lawsuit filed on behalf of dozens of Venezuelans detained and targeted for removal in Texas.
Legal Whiplash for Trump
Trump’s latest move was part of a broader and aggressive push to enact mass deportations under the renewed powers he’s claimed since returning to office in January. His legal team argued that the Alien Enemies Act gives him the authority to bypass standard immigration courts in cases where individuals are nationals of countries considered adversarial or unstable.
But the high court wasn’t buying it—not yet, at least.
“The administration’s interpretation of the statute does not pass muster under existing constitutional protections,” the court stated, stopping the removals while legal challenges play out in lower courts.
That’s no small blow for a president who has been trying to bulldoze opposition with sweeping executive authority—and it comes from a court that includes three of his own appointees.
Even Thomas and Alito Push Back
Justices Clarence Thomas and Samuel Alito, both long considered rock-solid conservatives, issued public dissents—but even they couldn’t stop the majority from hitting pause. The quiet but clear message from the court: Trump may hold the Oval Office, but his authority is not limitless.
“This ruling underscores how far even conservative justices are willing to go when executive power stretches too far,” said legal analyst Dana Givens. “This isn’t just a legal dispute—it’s a political warning shot.”
Trump Responds With Fury
Predictably, Trump erupted on Truth Social hours before the ruling came down.
“They are stone cold CRAZY!” he fumed in a furious post targeting unnamed “Radical Left SleazeBags.” He accused liberal activists of “PLAYING THE REF” by pressuring the Supreme Court and claimed Americans still overwhelmingly back his immigration policies.
“I hope the Supreme Court doesn’t fall for the games they play. The people are with us in bigger numbers than ever before,” he wrote, ending with his trademark rallying cry: “MAKE AMERICA GREAT AGAIN!!!”

Friday’s ruling is only temporary. The bigger legal question—can Trump legally use wartime powers to override modern immigration law?—remains unresolved.
The case is now expected to accelerate through the courts. Immigrant rights groups are gearing up for a landmark battle, while civil liberties watchdogs warn the implications go far beyond one group of asylum seekers.
“This case is about whether a president can use an 18th-century law to erase due process,” said Javier Márquez of the ACLU. “If that stands, we’re in serious trouble.”
Trump, meanwhile, is signaling he has no intention of backing down. But with even some conservative justices taking pause, his legal offensive may be entering choppier waters than he expected.
Bottom line: The high court just threw a wrench in Trump’s deportation machine—and even some of his usual allies are tapping the brakes.
