Lindsay Clancy Under Round-the-Clock Suicide Watch

Lindsay Clancy is reportedly under round-the-clock suicide watch after her high-profile triple murder trial ended in a mistrial, with her attorney saying he fears for the Massachusetts mother’s safety every day.

Clancy, 36, is accused of killing her three young children at the family’s Duxbury home in January 2023. Her attorney, Kevin Reddington, is now asking a judge to find her not guilty by reason of insanity rather than force her through another emotionally grueling trial.

“She’s strong. She has incredible family support. But she is suicidal,” Reddington told NBC News. “She’s on 24/7, one-on-one suicide watch. I worry about her every day.”

The stunning development comes after jurors spent more than a week deliberating but were unable to reach a unanimous verdict.

On Sept. 4, Judge William Sullivan declared a mistrial after the jury remained deadlocked, leaving prosecutors to decide whether they will try the case all over again.

Reddington said the nearly six-week trial took an enormous emotional toll on Clancy.

He said she was deeply hurt by the way prosecutors and witnesses spoke about her, but insisted she never expressed anger toward anyone involved in the case.

“She was hurt by the way they would talk about her and the way they would attack her,” Reddington said. “But she never once expressed anger towards anybody in the system.”

According to her lawyer, Clancy instead repeatedly talks about the children she lost.

“I want my babies,” she reportedly says.

Clancy was indicted on three counts of murder and three counts of strangulation in connection with the deaths of her children Cora, 5, Dawson, 3, and 8-month-old Callan.

Her defense has argued that she was suffering from severe mental illness, including postpartum psychosis, at the time of the killings.

Following the mistrial, Clancy’s legal team filed a renewed motion in Plymouth Superior Court asking Sullivan to enter not-guilty findings on all charges.

Reddington argues prosecutors failed to present enough evidence for a rational jury to conclude beyond a reasonable doubt that Clancy was criminally responsible for the deaths.

The defense also claims the jury was split 11-1, with 11 jurors reportedly prepared to find Clancy not guilty because she lacked criminal responsibility.

One juror refused.

Reddington had asked the judge to replace that juror during deliberations, but Sullivan declined and ultimately declared the mistrial.

The attorney later said he respected the juror’s right to disagree but became frustrated after the jury foreperson allegedly indicated the holdout juror would not follow the judge’s instructions on the law.

“I would defend that person’s right to be a holdout for a month,” Reddington said. “That’s what the system is about.”

But he said the situation changed when it appeared the juror allegedly had reasonable doubt while refusing to follow the court’s legal instructions.

“That’s when I was upset,” Reddington said. “It just wasn’t right.”

Plymouth County District Attorney Tim Cruz has not yet announced whether prosecutors will seek a retrial.

Clancy is scheduled to return to court Sept. 29 for a status hearing.

Reddington said he hopes the case ultimately brings more attention to postpartum psychosis and what he believes is a serious lack of psychiatric care for women experiencing the condition.

“It’s so easy for people to say, ‘Oh, come on, you don’t hear voices. You’re making that up. You’re lying. You’re evil,'” he said. “Because it’s easier to punish someone.”

Reddington said it would be easy for the public to simply label Clancy as evil and send her to prison, but argued that the reality is far more complicated.

“No one is discounting the horrific loss of those kids,” he said, adding that Clancy is painfully aware of what happened and “lives with that every day.”
