There’s been a lot of talk about former President Donald Trump appearing to doze off during his hush-money trial.

But could his naps sway the jury?

Jurors will likely feel slighted by Trump’s snoozing, legal experts told Business Insider.

And while closing your eyes during a criminal trial wouldn’t result in a conviction in itself, Trump’s naps aren’t going to help if any of the jurors are on the fence.

In the opening days of his hush-money trial, Trump closed his eyes for minutes at a time before jolting back up.

Since then, it’s been the same story: Trump’s been spotted with his eyes closed, his head tilted, appearing to nod off during the trial.

Even during the testimony of prosecutors’ key witness, Michael Cohen, Trump appeared to be napping in court.

The former President has denied falling asleep in the courtroom.

“I simply close my beautiful blue eyes, sometimes, listen intensely, and take it ALL in!!!” he explained on Truth Social earlier this month.

But he might be wise to keep them open in the future, legal experts told BI.

‘They will hold that against him’

Gene Rossi, a former litigator with the Department of Justice, told Business Insider that in the 110 cases he’s tried, all the jurors took their jobs very seriously.

“If they sense that the defendant is essentially blowing it off and not taking it seriously like an eighth grader, they will hold that against him,” Rossi said. “End of story.”

“That is a proverbial middle finger to the jury,” agreed Jeremy Saland, a former Manhattan Assistant District Attorney and current defense lawyer, who said dozing off would be a “foolish, dangerous way to handle yourself in that courtroom.”

For his part, Rossi said he advises clients to be engaged and respectful “like they are in church listening to a sermon by the Pope.”

Jurors had to go through a rigorous selection process and are giving up weeks of their lives to hear testimony.

But these proceedings carry unprecedented weight, Saland said.

There’s all the news coverage, not to mention the sheer magnitude of deciding the first criminal trial of a former US president — who could still become the next President if he wins this year.

Saland said Trump’s demeanor shouldn’t impact his verdict — which will ultimately boil down to the evidence. But it could be risky if deliberations get close, he said.

“You should think that the system is there and has enough accountability and integrity that they won’t hold it against him,” he said, “but it certainly will not favor him.”

Lawyers for Trump and members of his campaign didn’t respond to requests for comment from Business Insider.

  1. I understood President Trump didn’t get a great deal of sleep normally.

    Anyone of any age would need a nap experiencing the stress he is constantly dragged thru increasingly since 2015!

    I should think a nap would be a necessary reprieve in the midst of continual LIES & INUENDO!

  2. I can relate to this , when I desire no distractions to something important being presented , my full attention is gained by closing my eyes and listening intently. A professor called me down , thinking that I dozed off. After class, I apologized to him and explained my eye closure. He realized there was no disrespect intended , as he had paused speaking , I opened my eyes as he was admonishing me . This is a practice that I have ,to formulate and process a mental image .

  3. I don’t believe he is napping, I think he is thinking about other things. Democrats will tell you any lie about President Trump to turn you to vote for them. Not. When is the election interference going to stop and hold those accountable? Democrats get by with murder yet they attack President Trump and others, why? If democrats are obeying laws then why attack? If basement boy really won the 2020 election then why attack? If no one is above the law, then why are democrats allowed to break them all? If democrats are trying to save democracy then why are they attacking, lying, cheating, breaking laws, allowing illegals free everything including voting illegally? I hope President Trump is just thinking how to turn this country back to where it was great before democrats unleashed a killer virus on us and him just to destroy us and him. Remember President Trump works more then vacation boy ever thought of.

  4. I would doze off also….think about how early he must need to get up to get ready for this BS Kangaroo Court. He is probably thinking…”Here we go again….another day of court for a big nothingburger with a side of lies. BOOOORING!” Another take on this: how about…He was praying? I can just hear him: “Please Lord, Oh PLEASE Lord….make this nightmare just go away!! You know I am innocent of what they charge me with. Help the jury to see the farce that they are putting on.”

  5. This sounds like when I came out of the coma a couple of years ago. I was in a room, by myself, and closed my eyes. After about 20 minutes a nurse came in to “check on” me…I told her I was contemplating the universe. After 5 weeks in the coma I guess they were afraid I slipped back into it 🙂

  6. Evryone should know that President Trump is used to having very busy and long working days from early morning to well into the night. His stamina is legendary. So, unlikely as it may be that he doses off in court, even if he does, it should not be surprprising given the fact that he is being subjected to the abusive trial without any evidence of an actual crime or wrong doing.
