Manhattan District Attorney Alvin Bragg has filed a federal lawsuit in an attempt to block a subpoena issued by the House Judiciary Committee to a former prosecutor who played a crucial role in investigating former President Donald Trump.
The subpoena was served on Mark Pomerantz, who resigned from Bragg’s office last year as a special assistant D.A. Pomerantz and another prosecutor quit after Bragg indicated he would not pursue an indictment against Trump in connection with false statements about the valuations of real estate assets owned by the Trump Organization.
The complaint, filed in U.S. District Court in Manhattan, states that Congress has no power to supervise state criminal prosecutions and that the inquiry into the D.A.’s prosecution of Trump is an “unprecedentedly brazen and unconstitutional attack.” The suit names as defendants the Judiciary Committee, its Chairman Jim Jordan, and Pomerantz.
The subpoena seeks to compel Pomerantz to testify in a deposition on April 20th. Bragg’s suit states that the subpoena and other demands by Jordan for information “seek highly sensitive and confidential local prosecutorial information that belongs to the Office of the District Attorney and the People of New York.”
The suit argues that Congress has no right to demand such information, as basic principles of federalism and binding Supreme Court precedent forbid it.
The battle between the D.A.’s office and Trump’s allies in the House began when the Judiciary Committee opened an inquiry into the D.A.’s prosecution of Trump.
The prosecution is related to a $130,000 hush money payment that Trump’s then-lawyer Michael Cohen paid to porn star Stormy Daniels shortly before the 2016 presidential election. The grand jury indictment alleges 34 felony counts of falsifying business records.
The suit filed by Bragg escalates the battle, with the D.A. arguing that the House inquiry is an unconstitutional attack on an ongoing criminal investigation of the former president.
